Following your request for a review (our ref: 101003832329) of your Freedom of Information (FOI) Request – Corporate Leadership Restructure (our ref: 101003819150) – a review meeting was held on 27th August 2025. In attendance were the Information Governance Manager and Data Protection Officer, Senior Solicitor, and Information Co-ordinator, in consultation with Head of HR, ICT and OD or Head of Governance, Strategy and Performance.
Your FOI Request (101003819150) from 7th July 2025 was discussed.
The Panel reviewed the original response and the information provided; it concluded that the decision to withhold information under the exemptions provided were correctly applied and are upheld. We maintain that it is not in the public interest for confidential papers to be published, as this would, as previously explained, be likely to prejudice substantially the effective conduct of public affairs; as such, exemption S.30(c) of the Freedom of Information (Scotland) Act 2002 (FOISA) – Prejudice to effective conduct of public affairs – still applies. Similarly, FOISA exemptions sections 36(2) and 38(1)(b) are also still applicable; the report is classed as confidential because it contains information relating to staffing matters and consultations in connection with labour relations. We apologise that the original response only stated Section 38, not Section 38(1)(b).
As previously indicated, in case it is helpful, the minute of the meeting of 25th June 2025 is likely to be published in the next few days, following its ratification on 27th August 2025.
