I am requesting a review to your response to the above FOI request.  The request does not answer any of the specific questions asked.  The response provided a link that requires a password, thereby not answering the questions.  The response give a list of suppliers with no specific tender details given.  The response therefore fails on both counts.

Response 23-03-2023 

Following your request for a review of Freedom of Information (Scotland) Request (FOI request) - Electric People Carriers/Minibuses – 101003227734. A review meeting (our reference 101003260058) was held 20th March 2023. In attendance were Assistant Manager Procurement, Senior Solicitor, Information Governance Manager & DPO, and, Information Co-ordinator.

The Council’s response to your original FOI request received 30/01/2023 was discussed.

It was found that the original link sent in our response did not work because it was provided from a profile that was already logged in, and as such a password was required. This was due to human error; a different link that did not require a password should have been sent. We apologise for this error and for any inconvenience resulting from this. We have attached the relevant Contract Award Notices in PDF format instead for ease of reference.

Please see below our findings regarding each point of your request:

1. It was confirmed that there was no tender specification created for these purchases, as such exemption Section 17, Information not held, should have been applied. As previously stated, these vehicles were purchased via Direct Award from an existing framework. Nonetheless, some information on this is held in the Moray Council Contract Register which is publically available at; http://www.moray.gov.uk/moray_standard/page_101331.html which may be of interest.
In hindsight, this should have been made clearer in our response, we apologise for this.
     
2. These vehicles were purchased via direct award from an existing Framework, as explained above, as such there were no invitation to tender documents. Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.

3. Please find attached Contract Award Notices for all but the three 3 x Vauxhall Vivaro (9 seat) vehicles. These vehicles were purchased via the Scotland Excel / Crown Commercial Services Framework, where a Contract Award Notice is not published for recurring spend against a Framework. The estimated value of the Framework is contained in the Moray Council Contract Register, available here:

4. Please see attached Contract Award Notices here and here; please note that 3 x Vauxhall Vivaro (9 seat) vehicles were purchased via the Scotland Excel / Crown Commercial Services Framework as per point 3., so that information will be included in the estimated value of the Framework that can be found in the Contracts Register.
