1.-3. Copies of information held by Building Standards is restricted to interested parties under Section 58 of The Building (Procedure) (Scotland) Regulations 2004. The information requested is therefore exempt under Section 26(a) of the Freedom of Information (Scotland) Act 2002 'Prohibitions on disclosure under an enactment'.

This exemption applies if legislation currently prohibits the disclosure of information by the Council and this takes precedence over the Freedom of Information request.

The Building (Procedure) (Scotland) Regulations 2004
Regulation 58 of the Building (Procedure) (Scotland) Regulations 2004. This states that the copying of drawings and detailed information in Part II of the register is subject to certain restrictions. For residential buildings (including individual dwellings), copying is limited to anyone with an interest in the building, such as the current (or prospective) owner, occupier or tenant and an interested party of an adjoining building.
