FOI Request - Ownership of River Lossie

Request 101003842234

Who holds ownership of the River Lossie within the boundaries of Moray?

If ownership is split among different individuals, organisations, or authorities, could you please provide a breakdown by section or area?

If the Council does not hold this information, I would be grateful if you could advise which authority or organisation does.

Response 19-09-2025

The information requested is held by the Land Registry of Scotland. For ease of reference, please see the following webpage: https://scotlis.ros.gov.uk/map-search

where you can check who owns what land.

Please note, the Crown owns the beds of tidal rivers, while for non-tidal rivers, the legal presumption is that adjoining landowners own the riverbed up to the mid point of the river unless another party can demonstrate that it holds rights of Title.

This means the riverbed is owned by the Crown, a single landowner, or split between multiple landowners, depending on whether the river is tidal, flows only through one person's land, or runs between two or more properties. Therefore due to the length of the river I would expect that there will be multiple owners along its' length.

Accordingly, the Council will only hold records of land in its' own ownership and is unable to provide a breakdown of who else may own other sections.
