1. Section 17 – information not held – is applicable because Moray Council has no input or role in the administration of the Beatrice Community Benefit Fund. It is long established that given the risk of perception that planning decisions might be influenced by the perceived incentives of Community Benefit funds, that it does not play any substantive consideration in the planning consenting process, and nor does the Moray Council (as Planning Authority) then oversee of take part in its administration or monitoring.
