1. Can you confirm the number of bonds that were taken by Moray Council in relation to the Morlich Homes Castlewood development?

2. Can you confirm the original value for each bond that was taken/held by Moray Council?

3. Can you advise how much remains in Moray Council possession for each bond still held?

4. Can you confirm that the remaining bonds held by Moray Council for this development will be fully spent on completing the outstanding matters on this development only?

5. If it is Moray Council intention to only use part of the remaining bonds for completion of this development where will the remaining bond value go?

Response 10-12-2024

1. The development was constructed in 5 phases with a bond lodged for each phase.

2. The original road bond was sufficient to carry out all works in relation to the adopted road network. The specific information regarding the bonds is commercially sensitive. Disclosure of the requested information could substantially prejudice commercial interests and so it is exempt under section 33(1)(b) of the Freedom of Information (Scotland) Act 2002, commercial interests.

3. We hold 20% of the original bonds which will cover the estimated costs of the remedials.

4. A bond can only be used for matters relating the completion of works on the adoptable infrastructure on the site specified in the bond.

5. Any remaining bonds would be returned to the bond provider.
