The purpose of this request is to gather information on existing water supplies in the council area, so we can properly assess the potential effects that any potential new water abstractions installed could have on the local environment and existing water supplies. Therefore location data is vital to this assessment.
Is there location data (e.g. coordinates) and rest water levels that could be provided along with this data?

Following your request for a review (our ref: 101003534410) of your Environmental Information Request (EIR) - Private Water Supplies in Moray - 101003514312, a review meeting was held on 8th April 2024. In attendance were the Information Governance Manager and Data Protection Officer, Systems Manager Development Services, Solicitor, and Information Co-ordinator.
Your EIR Request from 27th of February 2024 was discussed.
We reviewed our response of 21st of March 2024. It was found that adequate information on how to access the information requested has been given and that all the points of your original request have been addressed. In detail these were:
1. Location / co-ordinates – this information is publicly available and extensive instructions on how to access it has been provided in our original response. We stand by our decision to apply 6(1)(b) of the Environmental Information (Scotland) Regulations 2004 - information already publicly available.
2. CAR licence or registration details (including permitted abstraction volume) – this information is not held by the Moray Council. We would suggest contacting the Scottish Environmental Protection Agency (SEPA) for this information, as this information falls under their remit. We uphold our use of exception 10(4)(a) of the Environmental Information (Scotland) Regulations 2004.
3. Date of installation – this information was supplied in the form of a spreadsheet as part of the original response.
4. Type of water supply - this information was supplied in form of a spreadsheet; if there is information you would have liked to receive over and above what has been given it is possible that this information is not held by the Council, in which case exception 10(4)(a) of the Environmental Information (Scotland) Regulations 2004 applies.
5. Depth of any borehole, and water level in any borehole – information not held and/or held in a non-retrievable format. We maintain that exception 10(4)(a) of the Environmental Information (Scotland) Regulations 2004 applies.
6. Details of any inspections or testing that may have been completed – this information has been supplied in the spreadsheet – please refer to columns E to G including information regarding the date of the last risk assessment date (where available), last sample date and sample result.
We therefore are not able to significantly amend our original response and uphold our previous exceptions.
