FOI Request - Reports and Requests to Council regarding River Spey

1.  On 15th September, 2021, a report drawn up by and on behalf of Innes Community Council regarding the river Spey was submitted to the Full Moray Council.   We are led to believe that that report was forwarded to other agencies including SEPA and the Scottish Natural Heritage now  Naturescot.   Can you please supply under the Freedom of Information legislation details of all agencies/stakeholders  who were sent copies of the report and attached proposal submitted by Innes Community Council.   Can we please have copies of any response to those reports submitted to the Council by other bodies/Stakeholders.

2.  In February/March, 2023, this organisation wrote to the Planning Department of Moray Council asking if a proposal for engineering works on the River Spey required planning permission or not and if so what the cost would be.   We now understand that Moray Council treated the information request as a pre planning  advisory notice, sent details of our request and information attached to it to other agencies/stakeholders asking their opinion on the suitability of the project as if it was a planning application.  Under the relevant legislation can you please advise to which agencies/stakeholders the information was sent and copies of any response to thoise papers.

Response 25-07-2023

1. The report by cbec provided to Moray Council by Innes Community Council stated that SEPA and SNH (now NatureScot) had been consulted on the proposals in the cbec report. The consultation undertaken with these bodies was also stated by Councillor Macrae at the meeting of Moray Council on 15 September 2021.  Moray Council contacted these bodies to confirm this and offered a copy of the report. SEPA confirmed they had and already supplied a response directly to the author of the study. No written reply was received from SNH (now NatureScot). Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.

2. The following parties were consulted on the pre-planning application enquiry submitted by Speymouth Environmental Partnership:
