1. Can you tell how many times, in each of the last five calendar years up to the date of this request, has the local authority sought a warrant to enter a tenant’s home after they have been unable to contact them?

2. For each of those cases, how long had passed without contact with the tenant before the warrant was sought?

3. For warrants that were served, how many resulted in the discovery of a deceased tenant or tenants inside the property?

1. Nil - not held. The Council has not sought any warrants to enter a tenant’s home. Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.

NOTE:
Notwithstanding the above response, there are circumstances where landlords are required, on the basis of statutory responsibility and/or tenant welfare, to force entry but which do not require warrants to be obtained. This provision is used sparingly, for example in case of gas safety work or tenant welfare concerns (which would typically include police attendance).
