Review of 101003210811 Speed Survey Test Results

To make you aware my Freedom of Information request was asked for on the 12th December 2002, this was after phoning Moray Council previous to that date and asking for the information, to be told: call back in 5 days for an update, numerous times, calls are logged with Moray Council

I also emailed on 14th November asking for this information, email copies available

I was told by Eilidh Robertson off Moray Council that Nicola Moss had to sanction and authorise the information I am seeking before I can receive it, at no point was I informed of your department or that my FOI request had to be sent to yourselves until correspondence from Caroline O'Connor Moray Council on 6th January 2023

I was under the impression a Freedom of Information request should be dealt with within 20 days

If I can supply yourself with any other facts please do not hesitate to ask, im very grateful for any help you can give in gaining the information as this has been ongoing for months now.

Response 23-02-2023

Following your request for a review, our ref 101003238020, a review meeting of Freedom of Information (Scotland) Request (FOI request) Speed Survey Test Results - 101003210811 was held on 15th February 2023. In attendance were Head of Environmental and Commercial Services, Solicitor Licensing and Regulatory, Information Governance Manager & DPO, and Information Co-ordinator.

The Council’s response to your original FOI request received 26/12/2022 was discussed.

It was found that your requests were initially handled directly by the department, particularly as some were verbal requests submitted by telephone. Information was given directly to the requestor. Once your email from 26/12/2022 was clearly recognised as an FOI, it was logged and processed as such - made available online with the relevant data to fulfil the request (http://www.moray.gov.uk/moray_standard/page_146174.html ). It was confirmed that the response was provided without any exemptions applied.

The review panel conformed that there had been some delays due to complications regarding overlapping requests and correspondence, followed by the Christmas holidays and closure days, as well as, workload pressures felt by the Department. We apologise for any inconvenience caused by this delay.

Please note that you can make an Freedom of Information Request in order to obtain information held by the Moray Council; for further information please see here http://www.moray.gov.uk/moray_standard/page_53728.html .

For further information on how to place a complaint, should you so wish, please refer to the Council's Complaints website http://www.moray.gov.uk/moray_standard/page_1379.html

Lastly, if you are still dissatisfied with the outcome of this review, then you may appeal by writing to the Scottish Information Commissioner via their online appeal service at www.itspublicknowledge.info/Appeal or to Kinburn Castle, Doubledykes Road, St Andrews, Fife KY16 9DS.
