FOI Request - Core Paths
Request 101003135818
Back in 2020 I requested data for Core Paths in the Moray area.
This you supplied but with a licence for personal use only.
Several councils - Highlands and Borders, for example - now release their equivalent data under an Open Government Licence.
Are you now able to release your data under an OGL, please?
Response 20-09-2022
The status of the Core Path 2011 data has not changed and is not available under Open Government Licence. The Core Path 2011 data, has been derived from Premium Ordnance Survey Products, therefore this data is bound by our Terms with Ordnance Survey originally through the One Scotland Mapping Agreement (OSMA) and currently the Public Sector Geospatial Agreement (PSGA). Where data is derived from Premium Ordnance Survey Products we cannot release the data under Open Government Licence (OGL) terms without the written permission of Ordnance Survey. Moray Council has NOT been able to obtain written permission from Ordnance Survey for publishing the Core Path dataset under Open Government Licence (OGL) terms.
Other local authorities may have derived their Core Paths datasets using Ordnance Survey Open Data Products and therefore able to provide their data under these terms, or been able to secure Open Government Licence for their data using different methods. We have used Premium Ordnance Survey Products to ensure our data is at higher accuracy to meet our business needs and therefore chosen not to use Ordnance Survey Open Data Products. We are currently going through the adoption of our latest Core Path Plan, once adopted we may review the licencing status of our core path data at that time.
