FOI Request - Sections 12, 68, 70 & 71 of Roads (Scotland) Act 1984

We would like to (and hereby do) make an Information Request that we be provided with the following details with regards to Notices/Orders that have been issued by Moray Council under the legislation listed above during the period July 2017 to July 2022.   
 
1. Notices or Orders that remain extant   
2. Notices or Orders that have been complied with and have monies owed to the Council   
3. Notices or Orders that have invoices pending in respect of works carried out by or on behalf of the Council to resolve the matter   
 
If it is not possible for the details of outstanding monies to be confirmed, we would be obliged if you can provide us with the following details:   
 
4. all notices served, or orders made by Moray Council from July 2017 to July 2022 under the legislation listed above   
 
When answering in the negative to any of the above, we would be obliged if you would confirm that you are doing so.   
 
Wherever possible we would be grateful if the information could be prepared to include the following:   
 
•reference numbers.   
•addresses of the subjects the actions are served over.   
•summary descriptions of the nature of the works/contravention.   
•relevant dates.   
•status of the action.   
•amounts owed to the council (when available).  

Response 02-09-2022

1. To list the details of every Stopping Up Order we would have to manually search through our records to identify which are Stopping Up Orders rather than other types of permanent or temporary road traffic orders. We estimated that we hold approximately 1100 Orders, that it would take around 3 minutes per document over the process at my hourly rate of £59. This would cost the Council in excess of £600. In accordance with section 12 of the Freedom of Information (Scotland) Act 2002, excessive cost, we are therefore unable to comply with your request.

2. No information held. Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.

The Moray Council (Section of North College Street (West), Elgin – Stopping Up) Order 2018 – came into effect on 17 August, 2018.
