1. What constitutes parking outwith a designated parking bay per Moray Council policy in this area?
a) Also, does this policy allow any local discretion as to the circumstances relating to the incident, including distance out with bay and proximity to other vehicles?
2. Are traffic wardens ( or whatever designation they have nowadays) paid a flat salary or is there payment related to the number of Excess Charge Notices captured each day?

1. With regards to what constitutes parking outwith a designated parked bay, please note this is not covered by Policy but is covered by the Car Park Order.
The Car Park Order 5. (1) (c) states:
‘A vehicle is left in a car park such that is does not conform with the manner of standing specified in this order’.
In the same order under 14. Manner of Standing in Car Parks the order states:
Every vehicle left in a car park where stalls are marked shall only use that car park by parking within a stall, and shall so stand that every part of the vehicle is within the limits of that stall.
(a) A vehicle parked outwith the limits of the marked stall will generally by impinging in a neighbouring stall and therefore there is no discretion used.
2. Car park attendants do not receive any additional payment with regards to the number of Excess Charge Notices issued in a day.
