Are Moray Council going to remark road markings on the cycle path from Elgin to Lhanbryde at the Lossiemouth turnoff.New Highway Code rules coming in this month give cyclists and pedestrians waiting to cross priority over cars, hgv vehicles etc.. At the moment the markings tell cyclists and pedestrians to giveaway. Should an accident happen at this junction will Moray Council be liable?

The changes to the Highway Code that come into effect on the 29 January 2022 give priority to pedestrians waiting to cross at junctions and at zebra crossings. Where the cycle path crosses the Belts Road, this is an uncontrolled crossing. Therefore we will not be changing the road markings at this location and cyclists will need to continue to give-way to vehicles using the road. The Moray Council would not be liable for any accident which may occur should a cyclist fail to comply with the existing road markings.
