2. How many applications for Listed Building Consent for the installation of uPVC windows in Listed Buildings in the Moray Council area in the period since 1st January 2010 have had such consent granted? – 0 granted by Moray Planning Authority but 4 subsequently allowed at appeal by the Directorate for Planning and Environmental Appeal

3. How many third-party reports of unauthorised installation of uPVC windows in Listed Buildings have been received by Moray Council in the period since 1st January 2010? – 14

4. Of these third-party reports, on how many occasions has Moray Council taken enforcement action in relation to such unauthorised works involving Listed Buildings in the period since 1st January 2010? – Of the 14 cases, 6 replaced UPVC for timber, 1 approved by the Local Review Body on appeal, 1 Enforcement Notice Issued , 1 no further action and 5 are current cases.

5. Where enforcement action has been taken, has the action been complied with on every occasion? –YES

In the event that Moray Council officers themselves have identified unauthorised installation of uPVC windows in Listed Buildings, how many times has Moray Council taken enforcement action in relation to such unauthorised works involving Listed Buildings in the period since 1st January 2010? – No requirement to take formal planning enforcement action as one occasion the applicant volunteered to change from UPVC to timber and on the other occasion the Local Review Body allowed the appeal following a refusal by Officers.
