1. How many complaints of landlord harassment and illegal eviction you receive from, or on behalf of, private rented tenants? the time frame is over the past 5 years.

2. How many enforcement staff do you employ to address these issues? and how has this changed over the past five years?

1. This information is exempt under Section 25 of the Freedom of Information (Scotland) Act 2002; information not held.

2. The information below relates to the operation of landlord registration.   

Responsibility for the administration, management and enforcement of the registration of private landlords will be undertaken by staff within the Housing and Property Service (currently within the Homelessness Strategy and Development Team).  Where appropriate, advice and referrals will be made to other services for example, Environmental Health or Legal Services. The type of enforcement action taken will depend on the level of the breach in the landlord registration scheme and the sanctions available (as determined by legislation).  

General enforcement action, such as issuing late application fees, will be undertaken by staff within the Homelessness Strategy and Development Team.  Specific case may be referred to the Landlord Registration Enforcement Panel.  This panel includes representatives from Legal Services, Environmental Health and Trading Standards.  Examples of such instances include, determining whether to send a report to the Procurator Fiscal.
