Can you tell me please for each of the last three years separately – 2012-13, 2011-12 and 2010-11 – how many times the powers have been used.
In each case, why was surveillance used, where and on whom? I am hoping you can tell me, for example, when the powers were used to target people suspected of flouting the smoking ban, people thought to have allowed their dogs to foul in public areas, those who were thought to have dropped rubbish, and youths suspected of antisocial behaviour.
Can you also tell me please where phone records have been obtained and agents sent into an area undercover – in every case. Also can you tell me how many times noise-monitoring equipment and CCTV equipment have been installed and why.
2010 - 4 uses of powers, 1X Covert Human Intelligence Source in relation to a vehicle purchase; 3X Directed Surveillance, 1 in relation to vandalism at a primary School, 1 in relation to the under age sale of petrol and the other in relation to the underage sale of spray paints.
2011 - 3 uses of powers, 1X Direct Surveillance in relation to the underage sale of tobacco; 1X Covert Human Intelligence Source in relation to a test purchase of R4 cards for Nintendo; 1X Directed Surveillance in relation to a test purchase of R4 cards for Nintendo.
2012 - 2 uses of powers, 1X Direct Surveillance in relation to test purchase of R4 cards for Nintendo; 1X Covert Human Intelligence Source in relation to a test purchase of R4 cards for Nintendo.
2013 - 8 uses of directed surveillance in total: 5 uses re sale of counterfeit goods; 1 use re the underage sale of tobacco; 1 use re the illegal sale of tobacco.
5 uses of covert human intelligence sources in total : 5 uses re sale of counterfeit goods.
For 2013 only the two cases re sale of tobacco involved the use of video equipment. In 2010 CCTV was used in one case re vandalism at a school and video equipment in another case re test purchase of spray paints. In 2011 video equipment was used in one case re underage sale of tobacco. Noise monitoring equipment does not appear to have been used at all.
