Private Landlord Registration Enforcement Policy

Scope of policy

This policy provides a framework encompassing the rights and responsibilities of the Council, in the management of the Registration of Private Landlords Scheme, including where appropriate, enforcement action.  

Legislation to enable the Registration of Private Landlords was passed by the Scottish Parliament in the Antisocial Behaviour etc. (Scotland) Act 2004 http://www.legislation.gov.uk/asp/2004/8/part/8 . The overriding purpose of the scheme is to give local authorities an effective means of dealing with the worst performing landlords who, by their behaviour and attitude, mismanage their properties, or fail to act in respect of their antisocial tenants.

This policy recognises the important role that the private rented sector can play in meeting housing need and tackling homelessness.
