FOI Request - Planning Assessments

I am writing to you under the Freedom of Information Act 2000 to request the following information:

1. Any assessment the council (or a group acting on behalf of the council) has made of the impact of the end of the transition period (or any similar document generated for end of transition planning purposes)

If planning for the end of the transition period has been handled collectively by multiple councils as part of a local resilience forum or similar, please forward this request on to the appropriate person at that body.

Moray Council have participated in a regional/national planning and preparedness process which carries a security cover and asks for those documents not to be released. 

In addition, there are a number of exemptions within legislation which apply to that work.  In particular, the following exemptions from the Freedom of Information (Scotland) Act 2002 are deemed to be relevant:

i.  Section 28 - where release would prejudice relations between the Scottish and UK Governments.  Both Governments feel that there are areas within the attached documentation which are deemed to be sensitive in nature so, their release would potentially prejudice that joint position and damage the relationship between both.

ii.  Section 30 - prejudicial to the effective conduct of public affairs.  The Council needs to be able to hold frank discussions internally, free from external influence - release of this documentation would curtail that ability.

iii.  Section 33 - release would be likely to prejudice substantially the commercial, economic or financial interests of the Council.  Release of the documentation could impact the relationship between the Council and local businesses.
