FOI Request - Evidence of Equality

My request under the FOI Act is that you provide me with a copy of the most recent reports submitted to your Council which detail what steps you have taken, and continue to take, to gather service user data as evidence which shows that you meet the Public Sector Equality Duty in relation to the function of the Council as a service provider and in particular to the elimination of any discrimination by the Council as a service provider on the grounds of disability, ethnicity, sexual orientation and religion [with particular reference to people identifying as Catholic or Protestant].  

I am in particular looking for reports which show that your Council has gathered data to evidence compliance with the Public Sector Equality Duty in how people from these equality groups [disability, ethnicity, sexual orientation and religion] are :

• able to access services equally with all other people,
• are able to experience a service quality equally with all other people, and
• are able to achieve a quality of service outcome equally with all other people.  

I would expect such reports to evidence that the Council has in place a plan for regularly gathering data and evidence across the range of services provided.  I would imagine such reports would also show that where there is an adverse differential found in the services experienced by some equality groups that the Council is taking steps to close that differential in service access, experience and outcome.

Should it be the case that your Council is not gathering such evidence, I would be grateful if you could confirm that this is indeed the case.

Following examination of the various performance reports of our services, we can advise that the evidence requested is not reported in the way specified in the FOI. Therefore, in accordance with section 17 of the Freedom of Information (Scotland) Act 2002 this information is not held.
