Please could you supply the answers to the following three questions relating to pothole compensation claims:

1.       How much money overall has been paid out by Moray Council in compensation as a result of claims (whether or not liability was accepted) relating to potholes involving (a) cyclists and (b) motorists in each of the last five financial years: 2013/14, 2014/15, 2015/16, 2016/17, 2017/18?
Please provide the responses for each year separately.

1.       How many individual (a) cyclists and (b) motorists have received compensation as a result of legal claims relating to potholes in each of the last five financial years: 2013/14, 2014/15, 2015/16, 2016/17, 2017/18?

1.       What is Moray Council’s total expenditure on legal costs defending and settling legal claims, including both their own and the Claimants’ legal costs, for pothole related claims in each of the last five financial years: 2013/14, 2014/15, 2015/16, 2016/17, 2017/18?

Due to the low numbers involved, a breakdown of cyclists and motorists could lead to the identification of individuals. this information is therefore exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002, personal information.

2. Due to the low numbers involved, a breakdown of the number of cyclists and motorists each year could lead to the identification of individuals. this information is therefore exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002, personal information. 

However we can advise that across the period there were 5 motorists and 1 cyclist. 

3. Due to the low numbers involved, a breakdown of the legal costs for each year could lead to the identification of individuals. this information is therefore exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002, personal information. 

However we can advise that across the period the total spend on legal costs was £23,419.
