FOI Request - Review of Elgin New Build Housing Allocations

In accordance with your reply to the information I requested ref number: 101001972922 I have a couple of queries. I don't understand why listing the point range of those that were allocated the new builds would reveal their identities. And if I could bring your attention to an earlier F.O.I request I submitted ref number:101001897368. Upon answering question 4b you listed the position of the recipients that have been allocated houses in Elgin this year so you clearly do hold that information. I would appreciate it I if received a more fuller answer.

Following your request for a review of our response to the FOI you submitted, Elgin New Build Housing Allocations - 101001972922 , a review was undertaken on the 12th and 13th December 2018. In attendance were the Records and Heritage Manager, Senior Solicitor, Senior Housing Officer (Information) and Information Co-ordinator.

With reference to your question, 4c, it was clarified that points are allocated to individuals based on their circumstances, points are not allocated per house. Therefore to disclose the point range for each house size could lead to the identification of individuals given that the numbers are so few. The Council upholds its decision to apply section 38(1)(b) of the Freedom of Information (Scotland) Act 2002, personal information. This is an absolute exemption and is not subject to the public interest test.

With reference to your question, 4d, it was noted that the list position was not provided previously for the new build properties. On review, the previous response should have been more detailed and included the rehousing list (homeless, transfer and waiting) and property type (ground floor, mainstream or sheltered). However, if broken down to this level then it is likely it could lead to the identification of individuals given that the numbers are so few. The Council therefore amends its decision and advises that this information is exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002, personal information.
