FOI Request Review of Council Vehicles and Private Hires
Review of Request 101001441336 Council Vehicles and Private Hires
Under advice from Police Scotland, we do not give out the registration numbers for Council owned vehicles.
"sorry then as the taxi regs given I will have to put in a request for review
most councils agree that as these vehicles are on the public highway these regs are easily obtained"
Following your request for a review of our response to the FOI you submitted, 101001441336 a review meeting was held at the council offices on 6th April 2017. In attendance were the Records and Heritage Manager, Senior Solicitor, Fleet Manager and Information coordinator.
It was agreed that the Council’s original decision is upheld; the information provided in response to your original request is exempt, however, the council did not explicitly apply an exemption as reason for withholding the information. I can now confirm that the information requested is exempt under Section 35 of the Freedom of Information (Scotland) Act 2002; Law enforcement, where disclosure of this information could prejudice the prevention and detection of crime.
In your review request you drew attention to the fact that the Taxi and Private Hire vehicle registrations are publically available, which is through our licensing portal. This is in accordance with The Civic Government (Scotland) Act 1982, Schedule 1, para 14 (3) “The register shall be open to the inspection of any member of the public at such reasonable times and places as may be determined by the licensing authority and any member of the public may make a copy thereof or an extract therefrom.” The electronic register is available on the website and is made available to comply with the licensing authority’s duties under the Act.
