FOI Request - 26-32 High Street Fochabers
1. Could I please have all the information the council holds on a complaint made about 26-32 High Street Fochabers. The complaint was received by Moray Council on Thursday 31 July 2014, and concerned groundworks that were being carried out on the site. The Moray Council ref number is 14/00055/GENENF
2. I would also like to know what enforcement action the Moray Council took in relation to the above complaint.
Information relating to planning enforcement is exempt under section 34(1) of the Freedom of Information (Scotland) Act, investigations by Scottish public authorities. However we can provide the following information:
The incident you refer to was reported to the Council on the 30th July 2014 and was dealt with by the Council’s planning enforcement team.
A site visit was conducted on that date where it was discovered that the old petrol tanks from the former petrol station were being removed. The site owner was advised that the work taking place required planning consent and that any further works should stop immediately until a planning application had been submitted and determined. The site owner complied with this request therefore negating the requirement to consider formal planning enforcement action. SEPA and the Council’s Contaminated Land section were also involved in this matter in relation to advising the site owner with regards to disposal of the petrol tanks as well as the tests and investigations needed for the planning application.
Building Standards were also involved in an advisory capacity in relation to safety matters but they had no concerns once the works had ceased.
In January 2015 a planning application was submitted to demolish the showroom/garage and erect retail development and flats which was eventually approved on the 31.03.2015.
